We, StudiOrchid LLC, an art gallery and art services company operating in New Jersey, are committed to protecting and respecting your privacy.  At StudiOrchid, we want you to know how we collect, use, share, and protect information about you. By interacting with StudiOrchid through our website, direct purchase at our gallery or at other exhibition locations, inquiry of our products through emails, phone calls, or other means, and services (the “Services”), you consent to the retain and use of information by StudiOrchid as described in this privacy policy. We may change or add to this privacy policy from time to time, so we encourage you to review it periodically.

1. Information that we may collect about you 

When you purchase our products, fill out forms on our website, contact us with enquiries, or otherwise interact with for our Services, we may collect personal information about you including your Personal Data such as your name, address, telephone number and e-mail address, profile such as your company name, address, your job title, photos, or payment data such as your credit card or account information. As you interact with our website, we may also automatically collect data about your browsing activities.

2. Third-party and data sharing 

Our Services may require the use of third parties.  We may share your Personal Data with our selected third-party and suppliers for the performance of our Services, including logistics and/or payment processing services in order to complete your purchase transactions.

Specifically,  those third-party payment service providers that we use to process your payment for purchasing our products such as PayPal or other similar services may collect your payment details, e.g., credit card number, account number, etc. These third-parties or their websites may have their own privacy policies or processing terms and we recommend you review them whenever they are shown or available to you. We do not accept any responsibility or liability for the privacy practices of such third parties.

We keep your information confidential, but may disclose it to our personnel, suppliers, or subcontractors insofar as it is reasonably necessary for the purposes of performing our Services to you. We may also disclose your information to the extent that we are required to do so by law (which may include applicable government bodies and law enforcement agencies) in connection with any legal proceedings or prospective legal proceedings, or to establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention).

We may legally use and retain your Personal Data where we need to perform the contract we are about to enter or have entered with you, when you request our Services, or when we deliver our Services to you such as:

  • Processing purchases including any shipping details for delivery of the artwork

  • Keeping track of contractual agreements

  • Keeping track of artworks offered to you to understand your preferences and purchase history and allow us to offer relevant artwork to you 

  • Responding to your enquiries 

  • Providing you with information and updates about the Services we offer 

  • Analyzing certain types of information that you submit to us for the legitimate interest of improving the Services we offer to provide you with a bespoke, tailored service and art advisory and consultancy service, based on your preferences, recommendations, interests and previous purchases and location

5. Provide our Services and acting for you as an artist  

For artist contracting or interested in working with us, we may legally use and retain Personal Data that we collect from or about you for the legitimate interest of providing a bespoke artist consultancy and representation service to you, such as: 

  • Promoting and selling your artwork on our website, in our gallery or at other galleries/exhibition sites managed or arranged by StudiOrchid

  • Retaining a personal profile of you and your artwork to provide clients with background information and market your artwork accordingly

  • Responding to enquiries about your or your artwork from potential buyers

  • Including your information in our promotional materials, such as for upcoming exhibitions or other events

6. Compliance and prevention of fraud and illegal activity 

We may process and retain Personal Data for the legitimate interests of ensuring that use of our Services is lawful and non-fraudulent, does not disrupt the operation of our Services, does not harass our staff or other individuals, and to enforce our legal rights and comply with our legal obligations, including compliance with anti-money laundering regulations (if and where applicable). Where we reasonably believe that you are or may be in breach of any of the applicable laws, we may use your personal information to inform relevant third parties such as your email/internet provider or law enforcement agencies about the content.

7. Marketing  

We use various forms of marketing to provide you with promotional materials about our Services. We may process your contact information that you provide to us (either via our website or through use of our Services) for the purposes of marketing in accordance with our legitimate interests to send you information about gallery exhibitions and events, and special sales. To that end, we may also use third party email providers, such as Mail Chimp, to process these marketing emails.

8. Your rights in relation to your personal data held by us

You have the right to request a copy of the Personal Data we hold about you and to have any inaccuracies corrected. If you are unhappy with the way we are processing your Personal Data, please let us know. We will use reasonable efforts to the extent required by law to supply, correct or delete personal information held about you on our files. 9. Data retention 

We will hold your Personal Data on our systems for as long as necessary or as required by law, or for accounting or regulatory purposes, or as  otherwise described in this privacy policy.

10. Children 

We do not knowingly solicit data from or market to children under the age of 18. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us. We will delete such information from our files within a reasonable time.

We will take all reasonable technical and organizational precautions to prevent the loss, misuse or alteration of your Personal Data. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.
